Terms of Sale

These Terms of Sale (the “Terms”) govern the subscription to the MacroDawn service between the publisher, Nicolas MORICET (sole trader), and any person taking out a subscription (the “Customer”). By subscribing, the Customer confirms having read and accepted these Terms.

1. Publisher

The MacroDawn service is published by Nicolas MORICET, a sole trader (entrepreneur individuel) registered under SIREN number 508 256 286, with its registered office at 78 avenue des Champs-Élysées, Bureau 326, 75008 Paris, France. Intra-community VAT number: FR 68 508 256 286.

2. Purpose and description of the service

MacroDawn is a macro-economic information and analysis platform for retail traders. It brings together and explains recognised public sources — market sentiment, the economic calendar, summaries of central bank communications — and delivers a concise read of them.

MacroDawn is an information and analysis tool. It does not constitute investment advice, a personalised recommendation, a solicitation or an inducement to buy or sell any financial instrument. No performance or gain is promised or guaranteed. Investment decisions are the sole responsibility of the Customer.

3. Account and access

Access to the service requires creating an account (email and password, or sign-in via a third-party provider) and an active subscription. The Customer is responsible for keeping their credentials confidential and for any activity carried out from their account.

Access to content and features is strictly personal and reserved for Customers holding a valid subscription.

4. Pricing, subscription and payment

The service is offered as a monthly subscription with no commitment. The applicable price is the one shown at sign-up and recalled before any payment. Prices are stated in euros, all taxes included (French VAT applies).

A reduced “founder price” may be offered to the first sign-ups: it stays locked for as long as the subscription remains active and uninterrupted, whatever modules are added later. After cancellation and re-subscription, the prevailing public price applies.

Payment is made by card, on a recurring basis, through our payment processor Stripe. MacroDawn does not store card numbers. The first instalment is charged at sign-up, then at each monthly renewal.

5. Duration, renewal and cancellation

The subscription is entered into for a one-month term, tacitly renewed for successive one-month periods until cancelled by the Customer.

The Customer may cancel at any time from their account, via the Stripe Customer Portal available in the settings. Cancellation takes effect at the end of the current subscription period; access remains open until then. Amounts already paid for the current period are not refunded on a pro-rata basis, subject to mandatory legal provisions.

6. Right of withdrawal

The service consists of digital content and a service performed immediately after sign-up. By subscribing and accessing the service without delay, the Customer expressly requests immediate performance and acknowledges waiving their fourteen (14) day right of withdrawal, in accordance with Article L221-28, 13° of the French Consumer Code.

7. Availability, data and maintenance

MacroDawn uses reasonable means to keep the service available, without guaranteeing uninterrupted or error-free operation. The service may be temporarily suspended for maintenance.

Content relies on third-party sources. MacroDawn does not guarantee the accuracy, completeness or constant timeliness of this third-party data.

8. Liability

MacroDawn cannot be held liable for the Customer’s investment decisions or for any resulting losses: the service is provided for information purposes and does not constitute investment advice (see section 2).

The publisher cannot be held liable in the event of force majeure, failure of a third-party provider, or misuse of the service by the Customer. These clauses do not limit the rights granted to the consumer Customer by law.

9. Personal data

The processing of personal data is described in the Privacy Policy, accessible from the footer. There the Customer finds the purpose of processing, hosting within the European Union, and how to exercise their rights (GDPR).

10. Intellectual property

The MacroDawn brand, the site, the application and their content are protected by intellectual property law. The subscription grants the Customer a personal, non-exclusive and non-transferable right of use, limited to the subscription period. Any unauthorised reproduction or redistribution is prohibited.

11. Customer service

12. Changes to the Terms

The publisher may amend these Terms. The applicable version is the one in force on the date of subscription or renewal. Any substantial change is brought to the Customer’s attention.

13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts are determined in accordance with the applicable rules, the consumer Customer retaining the benefit of the protective provisions of the law of their place of residence.
